Acceptable Use Policy
VPLS Technologies, (hereinafter "VPLS")
has drawn up this Acceptable Use Policy (the "Policy")
in order to protect VPLS and our customers from any
illegal operations which may occur. VPLS's customers
shall not, nor shall they permit or assist others
to abuse or fraudulently use of VPLS's Services, including
but not limited to the following:
(1) Sending unsolicited e-mail that
causes complaints from the recipients of such unsolicited
e-mail.
(2) Mailbombing (sending large quantities of unwanted
or unsolicited e-mail to individual e-mail accounts;
a.k.a. "Spamming").
(3) Unauthorized attempts by a user to gain access
to any account or computer resource not belonging
to that user (e.g., "spoofing"). Obtaining
or attempting to obtain service by any means or device
with intent to avoid payment.
(4) Absolutely no IRC daemons, eggdrop, XDCC transfer
bots allowed.
(5) Unauthorized access, alteration, destruction,
or any attempt thereof, of any information of any
VPLS customers, VPLS, and its end-users by any means
or device.
(6) Knowingly engage in any activities that will cause
a denial-of-service (e.g., synchronized number sequence
attacks) to VPLS, any VPLS customers or end-users.
(7) Using VPLS's Services to interfere with the use
of the VPLS's network by other customers or authorized
users, or in violation of the law or in aid of any
unlawful act.
(8) Using VPLS's Services inappropriately in ways
that can harm VPLS's reputation. These services are
not limited to any particular service and cover all
of VPLS's Services.
(9) All customer's must stay within their designated bandwidth limits each month or burst charges will be applied per month.
(10) Storing copyrighted material owned by others
is prohibited. VPLS relieves itself from all liability
steming from these materials and full responsibility
will be placed soley on the customer.
(11) Using VPLS's network to send viruses, worms,
trojans or other harmful programs is prohibited.
(12) Users caught with any exploitation programs,
virus, worms etc will be punished according to the
laws governing the state of California.
(13) Changing the "administrator" on Windows
based servers or "root" passwords on Linux
systems is strictly prohibited without the written
consent of a VPLS Technologies' System Administrator.
Removing Remote Administrator or changing passwords
where by VPLS Administrators can not gain access to
the machine is strictly prohibited.
Each VPLS customer is responsible for their own actions
and, by accepting service from VPLS, is agreeing to
abide by this Policy. In cases where VPLS does find
misuse of VPLS's Services or abuse of this policy
we will terminate the account of the offending customer
and take action as VPLS deems appropriate without
notice. |
Service Terms
VPLS is connected to a vast network on the core of
the Internet backbone provided by a large Internet
Service Provider (ISP) supplying the bandwidth and
connectivity. VPLS does not hold itself liable for
ISP down time due to ISP network or server failures.
VPLS does not guarantee "pings" to VPLS
servers as they vary from client to client depending
on geographical location and their current Internet
Service Provider.
VPLS observes the right to inspect any and all content
on VPLS servers or customer colocated servers as long
as they are connected to VPLS's infrastructure and
network. Any customer found in violation of the above
fore mentioned polocies will result in termination
of service and any other punishments VPLS deems necessary
as governed by the laws of the state of California
and federal laws. |
Contracts and Refund Policy
A contract must comply with the Acceptable Use Policy
and can not be broken under any circumstances. If
the contract is not ful-filled in the time space allocated,
the party is held accountable for the balances due.
A contract can not be cancelled under any circumstance
and if payments are not met, the party shall be held
liable. VPLS holds the right to cancel any written
or verbal contract anytime and withhold all payments
made prior to agreeing to the aforementioned contract.
If a party wishes to cancel the aforementioned contract
they must notify VPLS prior to the contract expiration
date. If not, VPLS observes the right to charge the
monthly payment as planned. All cancellations must
be made in the form of a support ticket using https://my.krypt.com
/. If a web hosting client changes registration
information without notifying VPLS, a $50.00 penalty
fee will be accessed. As of December 1st,
2004, there will be absolutely no refunds given under
any circumstance. |
